(AP) ? A judge struck down New York City's pioneering ban on big sugary drinks Monday just hours before it was supposed to take effect, handing a defeat to health-minded Mayor Michael Bloomberg and creating confusion for restaurants that had already ordered smaller cups and changed their menus.

State Supreme Court Justice Milton Tingling said the 16-ounce limit on sodas and other sweet drinks arbitrarily applies to only some sugary beverages and some places that sell them.

"The loopholes in this rule effectively defeat the stated purpose of this rule," Tingling wrote in a victory for the beverage industry, restaurants and other business groups that called the rule unfair and wrong-headed.

In addition, the judge said the Bloomberg-appointed Board of Health intruded on City Council's authority when it imposed the rule.

The city vowed to appeal the decision, issued by New York state's trial-level court.

"We believe the judge is totally in error in how he interpreted the law, and we are confident we will win on appeal," Bloomberg said. He added: "One of the cases we will make is that people are dying every day. This is not a joke. Five thousand people die of obesity every day in America."

For now, though, the ruling it means the ax won't fall Tuesday on supersized sodas, sweetened teas and other high-sugar beverages in restaurants, movie theaters, corner delis and sports arenas.

"The court ruling provides a sigh of relief to New Yorkers and thousands of small businesses in New York City that would have been harmed by this arbitrary and unpopular ban," the American Beverage Association and other opponents said, adding that the organization is open to other "solutions that will have a meaningful and lasting impact."

The first of its kind in the country, the restriction has sparked reaction from city streets to late-night talk shows, celebrated by some as a bold attempt to improve people's health and derided by others as another "nanny state" law from Bloomberg during his 11 years in office.

On his watch, the city has compelled chain restaurants to post calorie counts, barred artificial trans fats in restaurant food and prodded food manufacturers to use less salt. The city has successfully defended some of those initiatives in court.

Because of the limits of city authority and exemptions made for other reasons, the ban on supersized beverages doesn't cover alcoholic drinks or many lattes and other milk-based concoctions, and it doesn't apply at supermarkets or many convenience stores ? including 7-Eleven, home of the Big Gulp.

The rule, if upheld, would create an "administrative leviathan," warned Tingling, who was elected to the Supreme Court bench in 2001 as a Democrat.

In defending the rule, city officials point to the city's rising obesity rate ? about 24 percent of adults, up from 18 percent in 2002 ? and to studies tying sugary drinks to weight gain. Care for obesity-related illnesses costs government health programs about $2.8 billion a year in New York City alone, according to city Health Commissioner Dr. Thomas Farley.

Critics said the measure is too limited to have a meaningful effect on New Yorkers' waistlines. And they said it would take a bite out of business for the establishments that had to comply, while other places would still be free to sell sugary drinks in 2-liter bottles and supersized cups.

Beverage makers had expected to spend about $600,000 changing bottles and labels, movie theater owners feared losing soda sales that account for 10 percent of their profits, and delis and restaurants would have had to change inventory, reprint menus and make other adjustments, according to court papers.

The city had said that while restaurant inspectors would start enforcing the soda size rule in March, they wouldn't seek fines ? $200 for a violation ? until June.

Some restaurants had already ordered and started using smaller glasses for full-sugar soda, while others began experimenting with freshly squeezed juices as alternatives to soda for children's parties. Dunkin' Donuts shops have been telling customers they will have to sweeten and flavor their own coffee. Coca-Cola has printed posters explaining the rules.

The ruling "serves as a major blow to Mayor Michael Bloomberg's incessant finger-wagging," said J. Justin Wilson at the Center for Consumer Freedom, created by restaurants and food companies. "The court confirmed what most New Yorkers already know: They don't need a government regulator to dictate their diet choices. New Yorkers should celebrate this victory by taking a big gulp of freedom."

Jose Perez, a fifth-grade special education teacher in Manhattan who was getting a hot dog and can of soda from a street vendor, called the ruling "dead-on."

"Really, I think it's just big government getting in the way of people's rights," he said. "I think it's up to the person. If they want to have a giant soda, that's their business."

(AP) ? A report says Matt Lauer was ready to take the fall last year for troubles on NBC's "Today" show.

The Daily Beast reported Monday that Lauer told Steve Burke, the chief executive of NBC Universal, that he would leave if Burke thought the show was better off without him. Burke dismissed the idea. The account of the behind-the-scenes drama at the troubled morning show was confirmed by show spokeswoman Megan Kopf on Monday.

"Today" has slipped behind ABC's "Good Morning America" in the ratings, and the slide was more pronounced after Ann Curry's messy departure as Lauer's co-host last summer.

Many viewers blamed Lauer for Curry's ouster, but the report said Lauer had been urging NBC to move more slowly with plans to replace her.

Vatican jamming devices block cardinals' phones

Canadian Cardinal Marc Ouellet makes his way to Vatican City on Monday. Security is tight ahead of the papal conclave, which is due to begin Tuesday.

By Alastair Jamieson, Staff writer, NBC News

ROME ? Jamming devices to halt communication were installed at the Vatican on Monday, as part of a security lockdown ahead of the papal conclave.

The behind-the-scenes ballot process is supposed to remain a secret, but modern technology left Roman Catholic Church officials taking no chances.

Staff working alongside the cardinals voting inside the Sistine Chapel must swear an oath of secrecy.

"I expect they?ll be on a total lockdown," NBC News' Vatican analyst George Weigel said. "Security is tight. It?s got to be."

Jamming devices will be used at the Sistine Chapel inside the Vatican and the nearby guest residences at Santa Marta where cardinals will sleep during the conclave, officials told reporters on Friday.

After a weekend celebrating mass at their assigned parishes across Rome, all 115 cardinals are preparing to file into the Sistine Chapel tomorrow to begin the selection of the next pope. NBC's Lester Holt reports.

The move will ensure cardinals cannot communicate with the outside world or use social media. It will also prevent hidden microphones from picking up the discussions.

Any cardinals or Vatican workers ?- such as those serving food in Santa Marta ? breaching the code face excommunication from the church.

"Even who said, 'pass the salt' is a secret," wrote Sister Mary Ann Walsh, media relations director for the United States Conference of Catholic Bishops in a blog post. "In this electronic age, I worry some cardinals may go into iPad and Twitter withdrawal."

To prevent any contact with the outside world, cardinals will also be taken the 750 yards from Santa Marta to the Sistine Chapel by bus.

"The Vatican highly prizes the traditional Conclave secrecy ? even more so after the leaks scandal that have plagued it in the past months," said Alessandro Speciale, Vatican correspondent for Religion News Service. "Most of the jamming measures were already in use in 2005, but of course, back then there were no smartphones and iPads. While cardinals will probably take their commitment to secrecy seriously, some of them are avid [Tweeters] and bloggers, and they might risk going into internet withdrawal if the conclave drags on too long."

Weigel added: "It would be difficult for anyone to use a cellphone, even out of sight. With 115 cardinals in the Sistine Chapel, space is tight and it would be obvious if anyone was checking their phone."

China voted for new North Korea sanctions. Will it enforce them? (+video)

The real test will be in China's follow-through on 'little brother' North Korea.

By Peter Ford,?Staff Writer / March 8, 2013

A North Korean man works atop a utility pole as a soldier man on a post along the river bank of the North Korean town of Sinuiju, opposite side of the Chinese border city of Dandong, Wednesday. The UN Security Council responded swiftly to North Korea's latest nuclear test by punishing the reclusive regime Thursday with tough, new sanctions targeting its economy and leadership, despite Pyongyang's threat of a pre-emptive nuclear strike on the United States.

When the UN Security Council imposed new and harsher sanctions on North Korea yesterday to punish it for its most recent nuclear test, one big part of the story was the fact that China had gone along with the resolution.

But that may prove not to mean very much.

Beijing?s vote was widely seen as a signal of just how impatient China is getting with its ?little brother,? who has been getting more and more wayward in recent months, launching missiles and detonating nuclear devices despite public Chinese warnings not to do so.

But the Chinese vote was only the start of the story, point out Victor Cha and Ellen Kim, Korea analysts at the Center for Strategic and International Studies, a Washington think tank.

?The real test of China?s commitment will be in the follow-through. Will it not just sign on to sanctions, but will it enforce them with vigor?? the experts asked in an emailed briefing.

The initial signs are not encouraging.

(Read more about why China is unlikely to come down too hard here.)

The spokesman for China?s Foreign Ministry, Qin Gang, posted to the ministry website his government?s official position on the resolution on Friday.?It went on for four wordy paragraphs. It made not one single mention of sanctions.

Chinese companies make a handsome profit from trade with North Korea, which depends on China for nearly four-fifths of its imports. Most of that trade is perfectly legal, but some of it appears not to be. Luxury items that are meant to be banned from North Korea seem to find their way across the Chinese border without any difficulty, for example.

And the UN panel of experts monitoring compliance with previous sanctions resolutions has found evidence that banned exports from and imports to North Korea have moved through the Chinese port of Dalian.

?In the past, China-DPRK trade has increased in the aftermath of UN sanctions,? say Drs. Cha and Kim. ?One hopes that this will not be the case again.?

For the record, here is the CSM?s unofficial translation of Mr. Qin?s statement:

?The UN Security Council unanimously passed Resolution 2094 on March 7th Beijing time over the issue of the DPRK?s third nuclear test.

?As a close neighbor of the Korean peninsula, China has worked hard to ensure nuclear nonproliferation on the Korean peninsula and maintain Northeast Asian peace and stability. China supports the UN Security Council?s necessary and proper response to North Korea?s nuclear test.

China believes the UN Security Council?s relevant action should be helpful to maintain peace and stability on the peninsula and in Northeast Asia.
?
UN Security Council resolution 2094 showed the international community?s position against North Korea?s nuclear test and meanwhile promised to solve the Korean peninsula issue in a peaceful manner via dialogue and negotiation, and reiterated support for the restart of ?six-party talks. Generally speaking, the resolution is balanced. China takes an objective and impartial position and played an important and constructive role during discussion of the resolution.
?
Maintaining peace and stability on the Korean peninsula and in Northeast Asia accords with the common interest of the international community. China urges relevant parties to remain calm and restrained and refrain from taking any action that could escalate tensions, and calls for all parties to stick to negotiations and seek denuclearization of the peninsula within the framework of the six-party talks and to explore effective ways to attain lasting peace and stability in the region. China will continue to make unceasing efforts towards these goals.?

Advice For A Successful Web Design Strategy | Content for Reprint

Learning about good web design techniques is important if you want to make building and running successful websites easier. It is through good design practices that your site becomes more appealing and easy to use, which makes it attractive to visitors. Not only will this entice new visitors, but it will make them repeat viewers as well. This article may help you create a more successful website.

Getting help in designing your website isn't a failure. Web design includes web programming, interface design, creating content, as well as search engine optimization. Getting help shouldn't be embarrassing, everyone needs it - even the experts! If you are not comfortable working on a certain aspect of your site, consider hiring a professional to offer assistance.

There are newsletters that you can sign up for, which will keep you informed about web designing. These are good to get you back on track if you lose sight of your goals, and motivate you to get on the right path. Whether designers are well-versed in web design or just getting started, they are likely to find helpful information.

Hosting your own site may not be a wise idea, regardless of how much money you have to invest. You should do the design all by yourself (or as much of it as you possibly can), but allowing another person to be the keeper of your site will let you be free and will allow you to have your mind on different things and not just the site's security and safety.

Draw a few sketches of possible looks for your website. Use these sketches to conduct focus groups and see if there is a pattern to the changes people suggest you implement before opening your site to the public.

Though it's tempting to go all out with design elements, remember that many who visit your site are actually looking for valuable information. Keep your site simple and easy to navigate, and only include positive, relevant content and information. The more simple the page, the quicker it will load.

Free web hosting is not always the best bet for commercial sites; over time, it may lead to problems. Although everyone likes to hear that something is free, there really is no such thing. Though you won't pay for the hosting in dollars, your site will suffer when it is constantly crowded with advertisements that you have absolutely no control over. Not only can these ads conflict with your site's design and your business's philosophy, they will lose you a good number of potential customers who are unwilling to sift through them.

Error check, or validate, your web pages to avoid problems. If you use an WYSIWYG editor, your code is not clean. When using those programs, it's important to take the extra step and validate your code through a validation service. Go to the WWW Consortium website to validate your pages for free.

The more you practice and learn, web design will be easier and more comfortable for you. Try some easy web pages with C+ and HTML to learn the basics. Practice has to start sometime, so get to it sooner than later.

Keep your site fresh and up-to-date, and promptly remove any outdated content. Failing to update your page with current information and upcoming events will cost you in terms of site visitors. Visitors want to visit sites that have the most up-to-date information, and leaving up outdated information shows that you are not committed to that. Set a review schedule to update content and remove items that are no longer useful.

If you are determined to purchase a particular domain name, but discover that it is already in use, you should visit some auction sites that sell used domain names, for example Sedo. These sites are clearinghouses for outstanding domain names that are now unused or have been sold which you can now pick up for comparatively little money.

Be very critical of the fonts you choose. The font is one of the first items people notice when coming to a site. Overly ornate or obscure fonts should be avoided, as they may not display properly on site visitors' computers. If your reader doesn't have the font you require, their browser will substitute a default font instead, possibly throwing the layout of your entire page off. The results are uncontrollable and often unattractive.

If you intend to design and create more websites in the future, it will be beneficial to learn how to work with multiple platforms. Your future efforts will be more productive the sooner you learn platforms like Java, PHP, and MySQL. Whether you are designing a new site, or simply helping a friend launch his or her own, a wide variety of experience will help you.

You should always be ready and willing to learn new things during the process of designing your website. After you conquer one skill in web design, move on to the next one. While this will take time, it will be worth it in the end when you know enough to create site after site.

Have you considered writing a newsletter? When a customer can get frequently updated on things, they will keep visiting to see more. Put your sign up form on your site's sidebar to keep track of how many people sign up. Only send out a newsletter to people who have subscribed to it, otherwise you will have angry customers.

With the information from above in hand, you are prepared to take the beginning steps to create your website. Develop a budget, get some good advice, and start drawing up your plans. If you get started as soon as possible, it will be easier to build an efficient, visually striking website.

NAIROBI, Kenya (AP) ? Uhuru Kenyatta, the son of Kenya's founding father, was named the winner of the country's presidential election on Saturday with 50.07 percent of the vote, but his opponent refused to concede, alleging multiple failures in the election's integrity that he said has put Kenyan democracy on trial.

Supporters of Kenyatta ? a man accused by an international court of helping to orchestrate the vicious violence that marred the nation's last vote ? flooded the streets, celebrating in a parade of red, his campaign's color.

Refusing to accept defeat, Prime Minister Raila Odinga said the election process experienced multiple failures as he announced plans to petition the Supreme Court. Odinga asked for calm and for Kenyans to love one another, a call that may help prevent a repeat of the 2007-08 violence in which more than 1,000 people were killed and that brought Kenya to the edge of civil war.

Kenyatta's slim margin of victory increases the focus on a multitude of electoral failures that occurred during the six-day voting and counting process. Kenyatta surpassed the 50-percent level needed to avoid a runoff by just over 8,000 votes out of 12.3 million cast.

The United States, Britain and the European Union gave Kenya's new political era a chilly reception. All released statements congratulating the Kenyan people but none mentioned Kenyatta by name. The West had made it clear before the vote that it would not welcome a President Kenyatta.

Kenyatta faces trial in July at the International Criminal Court over allegations he orchestrated the murder, forcible deportation, persecution and rape of Odinga's supporters in the aftermath of the 2007 vote. Kenyatta, as president, may have to spend large chunks of his first years in Kenya's highest office in a courtroom in The Hague.

The United States previously warned of "consequences" if Kenyatta wins, the nature of which depends on what happens in coming months. Britain has said it would have only essential contact with Kenyatta as president.

In his acceptance speech, Kenyatta gave a nod to the ICC, saying he recognizes the nation's international obligations. He pledged to continue to cooperate with "international institutions," but he also said he expects the international community to "respect our sovereignty and the democratic will of the people of Kenya."

Kenyatta was immediately afforded the state security for a president-elect, traveling in a shiny black convoy from the tallying center to his election headquarters. In his speech, he thanked Odinga ? calling him "my brother" ? for a spirited campaign.

"Today we celebrate the triumph of democracy, the triumph of peace, the triumph of nationhood," he said, adding later: "My pledge to you is that as your president I will work on behalf of all citizens regardless of political affiliation. I will honor the will of Kenyans and ensure that my government protects their rights and acts without fear or favor, in the interests of our nation."

If Kenyatta's victory holds, the son of Jomo Kenyatta will become the fourth president of Kenya since its independence from British colonial rule in 1963.

In the wake of the Kenyatta's victory, minor skirmishes were reported, including youths setting tires on fire in the western city of Kisumu, Odinga's home region. But no major violence was confirmed around Kenya.

Government officials have been working for months to avoid the postelection violence that brought Kenya to the brink of civil war five years ago, when more than 600,000 people were forced from their homes after President Mwai Kibaki ? a Kikuyu like Kenyatta ? was pronounced the winner over Odinga, a Luo.

The election commission held a dramatic midday televised announcement where officials appealed to Kenyans to accept the results with grace.

"There can be victory without victims," said Ahmed Issack Hassan, the chairman of Kenya's Independent Electoral and Boundaries Commission.

Francis Eshitemi, an Odinga supporter in Nairobi's largest slum, Kibera, said it was clear his candidate had lost in a free and fair election and that he expected him to concede.

"The problem is that Raila doesn't have the numbers. There were a few irregularities, but the gap between Raila and Uhuru is big," he said.

Isaac Khayiya, another Odinga supporter, said: "This time we want postelection peace, not war. We will be the ones to suffer if there is violence. For them ? Uhuru, Ruto, Odinga ? they have security and they are rich."

The final results showed that Kenyatta won 6,173,433 votes ? 50.07 percent ? to Odinga's 5,340,546 ? 43.3 percent. More than 12, 330,000 votes were cast, a record turnout of 86 percent registered voters.

Kenyatta's task was not simply to beat Odinga, but to get over the 50 percent mark and avoid a head-to-head runoff. Eight candidates ran for president. Even if Odinga succeeds in dropping Kenyatta's final numbers below 50 percent and forces a run-off, he still has a huge gap in votes to make up in a potential second round.

Odinga listed election failures over the last week: a voter ID system was scrapped Monday after the technology failed; a preliminary tally of early returns froze and was scrapped Tuesday after computer servers overloaded; election officials said a computer error had inflated the number of rejected ballots by a factor of eight in the early tallying system.

"What Kenyans witnessed ... was the failure of virtually every instrument that the (election commission) deployed for the election," Odinga said. "They all failed despite the billions (of Kenya shillings) spent on them."

Some international observers suggested that fraud could have pushed Kenyatta over the top but none offered any proof.

Odinga compared the "rampant illegality" to how the presidential vote ended in 2007, when Kibaki was awarded a win even though Odinga and his supporters believed he was ahead. "We thought this would never happen again. It has most regrettably happened again," Odinga said Saturday.

Odinga said results from at least five of the 291 constituencies were disputed, though he pledged to accept any ruling made by the Supreme Court.

"I have stated that nothing could have pleased me more if I had lost fairly," he said.

International diplomats who have worked to prevent violence have pressed Odinga to honor his pledge to protest the results in the courts and not on the street. As sunlight faded across Kenya late Saturday with only scattered reports of the smallest of disturbances, it appeared Odinga's call for calm was helping keep the peace.

(AP) ? Magnum P.I., Ron Burgundy and Ron Swanson would be impressed.

Organizers of an annual laugh festival in Michigan say they've broken the world record for the most people wearing fake mustaches.

Gilda's LaughFest is reporting that 1,544 people donned various shapes and sizes of dark 'staches on Thursday, the Grand Rapids festival's opening day.

The record is awaiting Guinness World Record certification.

If it sticks, the record would be the third set at the festival in as many years. Last year the festival broke the record for the most people wearing fake animal noses. The year before, it was people tossing rubber chickens.

LaughFest officials say the previous fake mustache record of 648 participants was set in September at a St. Louis Rams event.

CPS-3 Cancer Study | WNEP.com ? Northeastern and Central ...

Posted on: 7:19 pm, March 9, 2013, by Julie Sidoni, updated on: 07:32pm, March 9, 2013

If you had the chance to help prevent cancer, would you?

The American Cancer Society says you have that chance now. There?s a long-term, nationwide study going on, and organizers want you to consider getting involved.

Marian Dreimann is a nurse at Endless Mountains Health Systems. We caught up with her last week at Elk Lake High School in Susquehanna County, signing up to be part of a nationwide study about cancer called CPS-3.

In her line of work, she sees cancer all the time, and feels helpless.

?It seems so little to say, ?I?m sorry.? There?s gotta be something we can all do to help,? said Dreimann.

CPS-3 will take an in-depth look at some 300,000 people nationwide: who is diagnosed, in some cases ? why, and at what age.

Erin Moskel is regional health initiatives representative from the American Cancer Society, which is behind the study.

?We?re looking at not only your lifestyle behaviors, but also the environment in which you live, your geography, your family history, and your current screening updates,? Moskel said.

Moskel spoke with Newswatch 16 at The Commonwealth Medical College in Scranton, which was one of the enrollment sites.

?If you, maybe, have a family member or friend who has battled cancer, or lost their battle, and maybe you want to give back in some way but you don?t have the money, this is a fabulous way to get involved,? she said.

Participants will be asked to fill out a baseline survey form, then some measurements will be taken, followed by a small blood draw. That information will then be coded and categorized. Participants are kept anonymous.

Then, for the next 30 years, that information will be analyzed, only if there?s a cancer diagnosis, to look for patterns in who gets cancer and who doesn?t.

Dr. Maurice Clifton signed himself up. He?s Senior Associate Dean for Academic Affairs at TCMC. He lost his mother to cancer and says getting involved is the right thing to do.

?There?s a lot more we don?t know about disease and what causes it than what we do know,? said Dr. Clifton, ?so, research efforts are critical.?

To be part of CPS-3, you need to be from 30 to 65 years of age. Men and women of all races and ethnicities are being asked to join. You must never have been diagnosed with cancer, but family history doesn?t matter.

This is fifth and final year for enrollment in the study. It will close in December.

There are ways you can enroll. It?s recommended you visit the study?s website at www.nepacps3.org to register.

I apologize for starting yet another (and I know it won?t be the last) post with the sentence ?So I bought a Groupon for.? So I bought a Groupon for a B&B with my boyfriend, the Catskill B&B in Stamford, NY. After looking through Groupons, I realized that I?d never been to a Bed & Breakfast before and since it was only a little over an hour away from the Capital Region we bought it with the private bathroom option. Before we even got there, I was happy with how accommodating Lewis and his wife Lilly were to us. The day we were to travel to the Catskills was projected to be one of the worst snow storms this Winter and when I called to ask about the weather conditions, Lewis told me that I could change my reservations if I felt more comfortable coming another weekend and I would not be charged for the change. We decided to just bare the potentially awful weather and long story short, the storm wasn?t that bad and obviously made it there safely.

When we arrived, we called Lewis and he met us at the door. After showing us to our room, we got a tour of the house and since at the time we were the only guests, had the opportunity to chat with Lewis a bit. He?s a very interesting guy if you have the time to talk to him. He does enjoy to talk so if that?s not the experience you?re looking for, I would make it known up front. We though enjoyed the conversation. We talked about a huge range of topics from art to game theory to radio to his books to other services offered at the Catskill B&B. We were only given one dinner inside of the house so on Friday night we went out into the snow storm to find food. This Bed & Breakfast was in a great part of town, only one block from Main St and is completely walkable. In case you forgot anything for your stay, there is a Rite Aid around the corner so though Stamford is a smaller town, you find yourself right in the middle of it.

For dinner, we stopped at Gabrielle?s Restaurant?(60 Main Street, Stamford) which was probably more of the fancier locations but the prices were still reasonable. HarrisonBB2I ordered penne a la vodka with a glass of wine. I?m not a trained chef and though I love to cook, most of my training is from the Food Network. One thing, a pet peeve if you will, that bothers me about food is when the outside of the plate is decorated and in this case with shredded cheese. They gave me extra cheese in a small container, I?m not going to take it from the outside of the plate where the waitress may have touched it and put it into my food. In my opinion, it?s useless and just looks?slipshod and messy. Other than my picky pet peeve, the dish was delicious. The sauce a perfect consistency, the pasta cooked beautifully and I overall really enjoyed it. Since there were no TVs or internet inside the B&B, we spent the rest of the night playing cards and watching Netflix on a phone. I find myself so taken over by technology sometimes, it was nice to play cards and have the time to talk without distraction, even if the TV was on in the background.

The next day we were welcomed with breakfast prepared for us by Lewis that we shared with another couple that was staying there for the weekend. Lewis made us a fruit salad, waffles and brought out tea, coffee and orange juice.66910_10101735363294849_1554447923_n He was very accommodating. ?After breakfast, we decided to head out to Windham Mountain?which was about a half hour drive away. We don?t ski nor do we snowboard but I love hanging out in that atmosphere. I would take the time to learn but it ends up being way more money that I intend to spend on a sport. After walking around and checking out the surroundings, we took a shuttle over to the Adventure Park across the street. I don?t downhill ski but it?s so difficult to live in this area and not participate in anything Winter so I usually cross-country ski or ice skate. Ice skating was closed because of the snow but there was the option to ski, snowshoe or tube. To rent and use the area, cross-country skiing was $25/pp but there is no time limit and the path is beautiful. They told us to follow the pink tags but going through the woods was challenging because of the fallen branches hidden under the recent snow. It was a great workout and added a mix of hills and flat land for an enjoyable dynamic.?For lunch, we went to the Adventure Park lodge and shared some chicken fingers and french fries and I enjoyed a well-needed hot chocolate.

Our Room; Photo Credit: Yelp

That night at the Bed & Breakfast, Lewis made a fantastic vegetarian dinner paired with a sumac drink he made, I believe it was. We started out with a?mediterranean platter that had falafel, grape leaves and hummus. The main course was a vegetable lasagna that tasted like there was meat but better. I really enjoyed the food he prepared for us along with the pancakes he made for breakfast the next morning. He didn?t eat with us but did sit at the table to chat while we were eating all meals to get to know us a little better. The whole environment of the Bed & Breakfast is very social. There is one TV in the house and if you?d like to watch movies, it becomes a household event. There was only one other couple but I would be curious what it would be like with more people. I can imagine an even more stirring conversation and a very interesting experience.

Our room was comfortable. The shower was challenging because there was no holder for the shower head and it?s been awhile since I?ve had to maneuver the shower head as well as pay attention to what I?m doing.?Overall, we really enjoyed our time there.?Everyone was very welcoming and the town of Stamford was very quaint.?The Bed & Breakfast also offers wellness packages including massages, stress management, etc and all the information can be found on their website if that?s more the experience you?re looking for.

Obama pushes ahead with export control changes

WASHINGTON (Reuters) - The Obama administration has notified Congress of plans to modify U.S. weapon and ammunition export controls to make it easier for American companies to export spare parts for aircraft and gas turbine engines, the White House said on Friday.

President Barack Obama also issued an executive order changing how export controls on military and certain high-technology goods are administered, the latest step in a reform initiative that dates back to August 2009.

"This is the beginning of putting in place the nation's new export control system," a senior administration official told reporters on condition he not be identified. "Our current export control system is very complicated ... It's designed to address the Cold War-era and hasn't been updated since that time."

The changes are aimed at simplifying export licensing requirements for less sensitive items and building better protections for the most critical technologies, administration officials said.

They would provide a streamlined export authorization process for thousands of parts and components used in aircraft and gas turbine engines, two of 21 categories on the U.S. Munitions List, the officials said.

Currently, everything on the U.S. Munitions List "is controlled equally, whether an F-18 fighter or a bolt that has been modified for use on that F-18, and each of these items requires an individual license," the White House said.

The new rules go into effect in 180 days of being published, unless Congress, which was notified of the changes on Thursday, moves to block them in the next 30 days.

"The new system will help our defense companies compete more effectively abroad while creating more jobs here at home," said Representative Adam Smith, the top Democrat on the House of Representatives Armed Services Committee.

Items such as assembled engines, bomb racks, missile launchers, fire-control computers, radars and weapons pylons will stay on the Munitions List, a senior administration official told reporters.

Former Secretary of Defense Robert Gates in April 2010 outlined the administration's long-term plan to merge two separate government lists that govern exports of weaponry and dual-use technology goods into a single list.

"We need a system that dispenses with the 95 percent of 'easy' cases and lets us concentrate our resources on the remaining 5 percent," Gates said at the time.

The Commerce Department currently issues export licenses for dual-use goods and technology with both civilian and military applications.

The State Department administers the U.S. Munitions List, which contains 21 categories ranging from firearms and tanks to satellites and nuclear weapons design and test equipment.

"Rebuilding our export control lists and moving less sensitive items from the State to the Commerce list will provide us the flexibility to more efficiently equip and maintain our partner's capabilities while allowing us to focus on preventing potential adversaries from acquiring military items that they could use against us," the White House said on Friday.

U.S. manufacturers have complained that restrictions on less sensitive technologies have cost them billions of dollars in lost sales that have gone to foreign suppliers.

A study by the Milken Institute for the National Association of Manufacturers a few years ago estimated that modernizing export controls could boost real U.S. economic output by $64 billion and create 160,000 manufacturing jobs.

Close U.S. allies have also complained that Washington's system makes it difficult for them to get spare parts for equipment they have bought from the United States.

Sennheiser MM550-X TRAVEL - Product Review - AVForums.com

Product Information

Product type - Wireless Noise Cancelling Bluetooth Headphones

Price at the time of review - ?349.99

Product Link - Buy Sennheiser MM550-X

Summary

Verdict - Portable headphones with built-in noise cancellation, bluetooth connectivity and mic/remote features.

Pro?s ? The MM 550-X sound good enough that you'll feel like it's money well spent, especially when using it wirelessly. Its active noise cancellation, while not class leading, is still fairly effective; if you want the best and don't need a wireless pair, the PSB M4U2 is a great alternative.

Con?s ? There is huge choice in the world of portable headphones, if you do not require all of the features on offer here you can save yourself money without experiencing a big drop in sound quality.

In-Depth Review

Introduction ? This is Sennheiser's portable that does it all, and at ?300 most people would be expecting that. Although they are not the most beautiful cans we have ever seen the build quality is excellent, they are more a model of German Efficiency than a statement of urban sophistication. The Sennheiser MM550X are circumaural with soft pleather earpads for long listening sessions in comfort. Despite the generous cups they are a small size, easily transportable. The right earcup is laden with controls, not surprising given the list of available functionality. Extremely flexible headphones, impressive technology, of course as with all wireless headphones, not all of the money goes into sound quality. The MM550Xs pair with a phone easily, charge over USB, and they fold easily into a portable carry case.

Included peripherals ? As well as a lovely pair of foldable travel headphones, you get - USB mains charger, USB charging cable, in-flight adapters, an audio cable, a neat carry case and the user manual.

Application ? Headphones don't come much more feature-packed than the Sennheiser MM550X. CD quality apt-X, NoiseGard sound cancelling technology, TalkThrough (a button turns on the external microphone so you can talk without removing the headset), Invisible microphone, cable option when power runs out, neodymium drivers, SRS WOW HD technology[FONT=Symbol], [/FONT]integrated track and volume controls. To save on weight, most of the unit is plastic, Steel runs through the headband to give flexibility and strength.

Description ? Sennheiser say the battery should provide 8 hours of listening with Bluetooth and NoiseGuard enabled, 10 hours Bluetooth without NoiseGuard and 20 hours using the cable with NoiseGuard activated. If you are looking for all the features on offer here then the MM550X are a good bet, however if you want the best sound quality then a well isolated closed back cabled headphone may be a better fit. If the NoiseGuard is the most appealing feature there are similar quality alternatives which have excellent noise canceling abilities for less.

Describe the sound - The sound quality is pretty impressive in standard mode although maybe a tiny bit Mid shy. On most occasions Bluetooth headphones still don?t match up to their cabled cousins but here the sound is nearly identical in cabled or Bluetooth mode, feeling much better than most traveling wireless headphones. Sennheiser's NoiseGard canceling technology is a different matter though, audibly degrading the great sound from standard mode. The SRS WOW HD button is in our opinion a pointless addition. It seems to add an aggressive smile curve EQ simultaneously making the top end a little scratchy and the bass muddy and over emphasized.

Comparisons ? Also see Sennheiser PX210, Jaybird SB2, Volume DH-B38, Sennheiser MM400X.

Warmer Weather on the Way

Our chilly breezes over the past couple of days finally died down a bit today.? It?s been a quiet, mild afternoon.? You?ve probably noticed the high clouds increasing from the west.? It will be a partly to mostly cloudy night for us.? Thursday, with partly sunny skies, we?ll see temperatures shoot up into the 70s again.

DALLAS DAILY PLANNER NIGHT

?

A huge upper level low continues to swirl in the Pacific Ocean this afternoon.? This system will be the one that gives us a shot at rain over the weekend.? Once it moves ashore in the Pacific Northwest, our computer information available goes up and we?ll have a better handle on the timing of the weekend rain.

KTVT Street Level

?

Right now it appears the best chance of rain will be early Sunday morning in the DFW area.? But showers should develop west of the Metroplex late Saturday afternoon.

NTX Rain Chances

?

The storms early Sunday could be strong, but they are arriving at a time when we won?t have the sun energy in the equation to aid in severe weather.? Let?s hope we get some get soakers because most of the area is still in a major drought.

NTX Rain Chances1

?

Rain and storms will push off the east during the morning hours Sunday but there still could be some activity in our eastern areas for Sunday afternoon.

NTX Rain Chances11

?

Skies should clear altogether by Sunday night and the first half of next week looks pretty docile.? Temperatures will cool down for Monday but should warm back up to above normal levels after that.

Relevant Tea Leaf: A Family Antique Chocolate Pot

Last night's supper was Shepherd's Pie - a comfort food that my family thoroughly enjoys. Shepherd's Pie is said to have originated in England, but was adopted by Irish people many years ago. ?It's a staple of Irish traditional cooking thanks to the trusty potato which was adopted by Ireland as a food crop in 1780. ?Shepherd's Pie is good anytime, but it's especially?appropriate at this time of year with St. Patrick's Day approaching. ?

Our tea was Promise Tea?and the flavor was Apple Cobbler [a black tea] from Cracker Barrel. Inspiring Gaither lyrics are on each tea bag tag. ? One tag said, "There's no other, we can turn to, who can help us face another day" [from "Gentle Shepherd"], and the other tag said, "I just feel like something good is on its way" [from "I Just Feel Like Something Good Is About to Happen"]. ?Remember those Gaither gospel songs??

In yesterday's blog I shared a porcelain shamrock trio that belonged to my mom. ?Today I'm sharing a chocolate pot that belonged to my great-grandmother. ?It's the oldest family heirloom I own, and it's definitely a treasure. ?Isn't it beautiful??

The backstamp.

Research revealed the Wheeling Pottery Company organized in 1879 in Wheeling, West Virginia. ?In 1887 it formed a second company called La Belle Pottery Company. ?In 1903 Wheeling Potteries combined Wheeling, La Belle, Riverside Pottery, and Avon Potteries [of Tiltonsville, Ohio]. ?The factories continued making their semi-porcelain, art ware, utilitarian pieces and sanitary ware. ?In 1909 the name was changed to Wheeling Sanitary Manufacturing Company when the company went into receivership and was reorganized to make sanitary ware [sinks/wash basins, water closets, and other bathroom fixtures].

The chocolate pot dates between 1887 and 1909, making it at least 104 years old. ?I can't believe it survived all these years, since there were 12 children in the family. ?Then it was passed to my grandmother, who had seven children. My grandmother passed it to my mother, and she passed it to me when she moved to her assisted living apartment.

The photo below shows my maternal great-grandparents, Joseph and Amelia, and their 12 children. They were married in 1880. [My great-grandparents are in the second row, center.] My grandmother, Lucy, was the fifth child. ?She is in the top row, third from the left. ?The photo is a black and white Xerox photocopy which explains its poor quality, but I'm happy to have it anyway.

Below is a photo of my mother's family. ?My maternal grandparents, Daniel and Lucy are in the center, surrounded by their seven children. ?They were married in 1918. My mother was the third child, and she is in the top row, far right.

I don't know how my mom happened to be the one who was given the chocolate pot, but I'm glad she was! ;-)

Sony Xperia ZL Now Available in Australia for $700/?550 Outright

Sony Xperia Z is available for purchase in Australia for several days now at various retailers, but no carriers are offering the phone for the moment.

However, the Xperia ZL is a new entry on the Australian market, so those who prefer this one over the slightly more expensive Xperia Z can check it out now at major retailer Mobicity.

Sony Xperia ZL costs $700/?550 outright and is only available in black color. Mobicity also sells the Xperia Z for $750/?590, but this one is available in black, white and purple. Check it out here.

Android enthusiasts that cannot afford to pay the no-term price may want to wait until one of the three Australian major carriers will add the Xperia ZL to its portfolio.

For the time being, Vodafone Australia confirmed it would bring the Sony Xperia Z to its customers on March 13, but there?s no word on the Xperia ZL at the moment.

Although Xperia ZL does not offer a level of ruggedness included within the Sony Xperia Z device, it still comes with some features that the latter lacks. For example, the Xperia ZL features IR connectivity and a slightly better 2370 mAh Li-Ion battery.

Design is also a bit different as the Xperia ZL has a slimmer bezel than the Xperia Z. However, both smartphones ship with Android 4.1.2 Jelly Bean operating system until Sony decides it?s time to offer the promised Android 4.2 upgrade.

Hardware-wise, the two Xperia devices are similar and come packed with 1.5 GHz quad-core processors, Adreno 320 GPUs and 2GB of RAM.

The Xperia ZL embeds 16GB of internal memory that can be further expanded up to 64GB via microSD memory card.

Another selling point of the phone is the hyper-vibrant 5-inch Sony Mobile Bravia Engine 2 display that supports full HD (1080 x 1920 pixels) resolution.

conclusion on auto-responder for online marketing - INFORMATION ...

Internet has come to stay, e-commerce has come to stay as well and Auto-responder must surely exist. There is money in the list they say and this remains true. You entice a customer with gifts or service in order for them to give you their email address and you in turn forward to them about your goods on the internet thereby drawing their attention to your product and how reliable you are.? For an effective online supermarket, an auto-responder is their soul mate. It will be hectic on you banging email to thousands of your customers that comes to your site in search of one thing or the other. Therefore with this idea of auto-responder, you can comfortably set it up within an hour and it will be there doing your work for you. ?

Be careful not to use your auto-responder improperly. Having one auto-responder respond to another auto-responder, for example, can be chaotic and could cause server overload. This situation occurs when you sign up for something using your auto-responder address. After the sign up, your message is sent to another person?s auto-responder, which responds to your auto-responder ? and this continues until it is manually stopped. Second, be aware that certain words or phrases used in your messages will automatically activate spam filters. When used responsibly, then, auto-responders can prove to be important automated tools for helping the success of your online business.
